Lasting Powers of Attorney Being Rejected

Freedom of Information (c) has recently produced data showing that over the last 5 years, nearly 130,000 Lasting Powers of Attorney (LPAs) have been rejected since 2018 (circa 52,057 Health & Welfare and circa 75,791 Property & Finance).


Some of the main reasons for LPAs being rejected:

a) Signing order (of the donor, certificate provider and attorneys);

b) Missing information or missing details of those referred to within the LPAs;

c) Incorrect witnessing;

d) Unworkable requests within the LPAs;

e) Amendments being made but not initialled and dated.


There are currently severe backlogs in relation to the registration of the LPAs and so any rejections only increase delays further and increase costs.
